These Terms of Use (“Terms”) describe how you may use Wine Queue. They are not legal advice to you.

Wine Queue (winequeue.com) is operated by AGRATERRA LLC, doing business as Wine Queue (“Wine Queue,” “we,” “us”).

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What Wine Queue is

Wine Queue is a flash-sale aggregator of licensed wine shops. We list merchant drops so you can find them. For current listings, we may link you to the merchant’s own website.

The Site’s service extends only to helping you find products listed by licensed merchants. We are not the shop.

Wine Queue is not a wine shop and is not a party to any sale. We do not:

sell wine or other alcohol
take payment
take orders
ship bottles
hold inventory
provide an alcohol license for your purchase
verify your age at checkout
handle returns, refunds, breakage, or delivery problems

Purchases, shipping, taxes, age verification at checkout, returns, and alcohol licenses are the licensed merchant’s. When you follow a link, you leave Wine Queue and deal with that merchant under that merchant’s terms.

Wine Queue is not a party to any sale or transaction between you and a merchant. Do not involve Wine Queue in a dispute with a merchant. We cannot take responsibility for a failed, delayed, or unsatisfactory purchase. If a dispute arises between you and a merchant, you agree to release Wine Queue from claims arising out of that dispute, to the extent the law allows.

2. You must be 21 or older

The Site is for people who are 21 years of age or older and who can lawfully view alcohol advertising where they are.

By using the Site, you represent that you are 21 or older. If you are not, leave the Site.

A 21+ notice on the Site is not a substitute for the merchant’s age check when you buy.

3. Listings, prices, and current vs past

Wine Queue is not liable for the accuracy of information we display.

Listings are captured snapshots of merchant offers. They can be wrong, incomplete, or out of date the moment they appear. Shops can be wrong, sold out, or already gone.

We make no representation and do not warrant that a product listed on the Site is in stock, or that the price shown on Wine Queue is the same as the price on the merchant’s website.

Prices on the Site are the merchant’s advertised figures as captured, not a price Wine Queue is offering. A listed deal price may be subject to the merchant’s own case, bottle, or shipping minimums. Confirm the real checkout price on the merchant’s site.
Stock status is the merchant’s status as captured, not Wine Queue inventory.
Photos, names, and critic scores come from merchant materials or the capture process. We may store a merchant excerpt in our archive. We display facts (name, vintage, price, size, numeric critic score and source). We do not display shop tasting notes or critic-quote prose. We do not promise displayed facts are accurate or current. We may display a merchant’s bottle photo to identify the listed drop, including a copy we stored so the listing still shows after the merchant’s drop URL dies. We do not claim copyright in those photos, and we do not claim a license unless we have one. If you are the rights holder of a merchant photo we displayed, send a notice via our Copyright / DMCA page at /dmca and we will take that copy down. If we have no merchant photo, we show a generic stock wine bottle we own. That image is ours; it is not a photograph of the listed wine.
Current Flash Sales are listings we still treat as live. They may include a link to the listed drop on the licensed merchant’s site. That link can still fail or point at a changed page. “Current” is not a warranty that the bottle is in stock or that the flash is still on.
Past Flash Sales are ended flashes only. A still-buyable listing stays on Current; it does not also live on Past. Past shows the shop name as a label only. There is no outbound shop link on Past. Do not treat a past price as a deal you can still take.

If a price, vintage, size, shipping minimum, or availability matters to you, confirm it on the merchant’s site before you buy.

4. Outbound links and how we are paid

Links on Current Flash Sales go to the listed drop on a third-party licensed merchant’s site. Past Flash Sales have no outbound shop link. We do not control merchant sites. The Site is informational. Current links are straight merchant URLs (not affiliate redirectors).

We do not endorse those merchants or their sites. We are not responsible for their content, availability, prices, stock, shipping, or any transaction you enter into with them. After you click, their terms and privacy policy apply. You use those sites at your own risk.

We do not currently get paid for clicks. Wine Queue does not sell wine. How we relate to merchants is described on our How we relate to merchants page. If we later use affiliate links, paid redirects, or get paid for clicks, we will update that page (and this section) before or when those links go live. We are not saying we already take a commission, and we are not saying we never will.

Merchant names on the Site identify the licensed seller of the listed drop. Use of a name or logo does not mean the merchant sponsors or endorses Wine Queue unless we say so.

5. Alcohol and lawful use

Alcohol laws differ by state and country. A listing on Wine Queue does not mean the merchant will sell or ship to you, or that the sale is lawful where you live.

You are responsible for complying with the law that applies to you. Licensed merchants are responsible for their licenses, shipping rules, and checkout age checks.

6. Allowed use

You may browse the Site for personal, non-commercial use, subject to these Terms.

You may not:

use a robot, spider, scraper, or other unauthorized automated means to access the Site or its listings, except as allowed by robots rules we publish
reverse engineer, decompile, disassemble, tamper with, or bypass security on the Site
copy, redistribute, sell, rent, or sublicense the Site or its compilation of listings without our permission
misuse the Site to target people under 21
pretend to be Wine Queue or a listed merchant
interfere with, damage, or place an unreasonable load on the Site

7. Intellectual property

The Wine Queue name, wordmark, and Site design are ours (or our licensors’). Merchant names, bottle images, and offer copy remain the merchants’ or their licensors’. We may store and display a copy of a merchant bottle photo to identify the listed drop. We do not claim copyright in those images. If we have no merchant photo, we may show a generic stock wine bottle we own (not a photo of that wine). If you are the rights holder of a merchant photo we displayed, send a notice via our Copyright / DMCA page at /dmca and we will take that copy down.

You may not copy the Site’s compilation of listings for your own competing service without our permission.

Copyright notices under the US Digital Millennium Copyright Act may be sent using the address on our Copyright / DMCA page at /dmca.

8. Privacy

Our Privacy Policy describes what we collect, including Contact form submissions and, when deal watches are offered, magic-link verified email, watch preferences, and alert emails (with unsubscribe).

9. Disclaimers

THE SITE AND ALL LISTINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, COMPLETE, IN STOCK, OR STILL OFFERED. WE DO NOT WARRANT THAT THE PRICE SHOWN ON WINE QUEUE IS THE SAME AS THE PRICE ON THE MERCHANT’S SITE. WE DO NOT WARRANT THAT LINKS WORK. SHOPS CAN BE WRONG, SOLD OUT, OR ALREADY GONE. WE DISCLAIM WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Wine Queue is not a party to your purchase from a merchant. Wine Queue is not liable for the accuracy of information displayed on the Site. You use the Site at your own risk.

If you are dissatisfied with the Site, your sole and exclusive remedy is to stop using it.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINE QUEUE AND AGRATERRA LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST BOTTLES, ARISING FROM THE SITE OR FROM A MERCHANT PURCHASE, INCLUDING A FAILED OR DISSATISFACTORY TRANSACTION WITH A MERCHANT.

If you are dissatisfied with the Site, your sole and exclusive remedy is to stop using it.

11. Indemnity

You will defend and indemnify AGRATERRA LLC, d/b/a Wine Queue against claims arising from your misuse of the Site or your violation of these Terms, except to the extent a claim is caused by our willful misconduct.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts of California, unless applicable law requires otherwise.

13. Events outside our control

We are not liable for a lack of performance or unavailability of the Site where the cause is reasonably beyond our control.

14. Changes

We may update these Terms. The “Last updated” date will change. Continued use after an update means you accept the revised Terms, except where the law requires more notice.
